The prosecution and the defense in he criminal trial had the phone records they needed to do what they wanted to do. Marcia introduced the 10:17 call into the record because it was not on the bill. Shapiro stipulated to its authenticity for the defense. As far as the prosecution and defense were concerned, those two items, the bill and the stipulation, completed the record of all the June 12calls that Juditha made to Nicole. O.J.’s attorneys in the civil trial were right to accept them if they believed they were legitimate. They had enough trouble on their hands with Fujisaki’s attitude about claims of planted evidence.
Charlie, I know that we have been through this a hundred times, but for the benefit of those who haven’t tracked those exchanges let me say again – people are VERY BAD at estimating time unless they have a reliable “clock” to anchor it to. The Mezzaluna witnesses had no reason to note precisely when the Browns left and no time-stamped event that they could peg it to. In the grand jury hearing De Bellow estimated “8:30, 8:40 P.M.” Karen Crawford said, “8:30 or 9. I'm not positive.” That’s where Marcia got “9:00.” And that’s why Dr. Johnson should not have used it. If the 9:37 call was made from Dana Point, the Browns had time to get there without Lou driving like a maniac.
I’m sure that Juditha’s first report that she last talked to Nicole at 11:00 – the long conversation about more things than they could pack into 2 minutes when Juditha called at 9:40 –actually ended at 10:28. That means Judith mistakenly thought that she called Nicole around 10:50 and she was off by 20 minutes. If she was thinking in half hour increments, like Karen Crawford, she was off by only 12 minutes. Other timeline witness (Schwab, Pilnak, Mandel) were off by that much or more until they had a chance to find a “clock” (a reliable temporal reference) to reconstruct a more reliable time. I think that Juditha last talked to Dominique around 11:00.
Lou did not confirm Juditha’s estimate. He wasn’t as sure as she was and told her on television (Dick Wagner and I must have seen the same show) to wait until they got the bill. In other words, Dr. Johnson was wrong. His premise was wrong. His theory was wrong. His facts were wrong. His motive was wrong. He was looking for a home run ball that would give O.J. an obvious alibi. It was a swing and a miss. There was no hidden or altered record of Juditha’s phone calls to Nicole. He did not find an 11:00 call because the end of Juditha’s last call to Nicole was 10:28. --Jasper
