The rest of Mark Day’s testimony http://simpson.walraven.org/nov18-96.html struck me as being the most revealing about his character.
John Edwards testified in the civil trial before Day testified. Edwards told his story about Nicole running to him in the ’89 incident. In Day’s November 8, 1994 statement to Vannatter and Thompson about the ‘84” baseball bat incident (he said, just as Fuhrman did that it happened in ’85) he said that Nicole met him at the door. On the witness stand in the civil trial he changed his story to say that Nicole came running out to him the way Edwards had testified that she came running out to him. Leonard picked up on the discrepancy and destroyed him.
The judge in the civil trial would not allow the defense to get into Day’s testimony with respect to Mark Fuhrman’s letter to the city attorney. Nevertheless, it is clear from his report to Vannatter and Thompson in ’94 that O.J.’s version of the incident, rather than Fuhrman’s was correct. Nicole was not in tears when Day arrived. She was angry. The idea that she was sitting on the car sobbing with her face in her hands the way Fuhrman described is therefore absurd. He clearly hadn’t talked to Fuhrman when he made his report. It seems just as clear to me that he did talk to him before he testified in the civil trial to elaborate on his story in a way that would make it more compatible with Fuhrman’s.
O.J.’s defense did not call the other Westec officer or the other LAPD officer to the stand. They should have.
