We can’t tell from the resources at our command where Bushey got his information about the joint custody arrangement or when he got it. With everything he learned since the murders he might not have had it straight in his own mind. By the same token, he might have been referring to the custody battle that O.J. was having at the time with the Browns. Nevertheless, I suspect that you are right about Fuhrman passing on this tidbit to Phillips who, in turn, passed it on to Bushey. If Bushey’s recollection was correct, who else with a link to Bushey could have known about it?
This gets back to what Fuhrman told his drinking buddies in ’92 about his affair with Nicole and intimate aspects of her anatomy that only someone close to her would know about. If Fuhrman knew about Nicole’s breast augmentation surgery as well as her divorce from O.J. it seems highly probable that he knew about the joint custody arrangement, too.
I don’t believe that either the Gigi letter or the IRS letter was presented in the criminal trial. I do know that both of them were leaked to the press and discussed at length by expert commentators during some breaks in the trial and on special Court-TV programs. Like O.J.’s suicide letter and the tape of his phone conversations during the “slow speed chase”, the issue was whether it would help or hurt the prosecution to do it. It certainly helped the prosecution to have the letters (written two days apart) publicly discussed.
You will find both of them in the civil trial transcripts (Jason’s June 8, 1996 deposition and Petrocelli’s November 22 questioning of O.J.). –Jasper
