Jasper, I agree with you--but not too sure about Tyson. He seems to have a violent nature. HE may not have considered it rape, however.
As to the victim's history--normally I would agree. But as you say, when the evidence to a problem is ignored by the prosecution as was in this case it appears--the only place for it to be is in open court.
There appears to be a rush to prosecute here-due to who the accused is. I didn't think that at first but after I heard about the second pair of panties with sperm and semen on them---well, that does not fit the profile of a rape victim.
I think it was telling that the judge took all this time instead of saying that very day to hold it over for trial.
I missed the announcement and only heard about it briefly but didn't the judge basically admonish the prosecution to get their ducks in a row before trial?
