I think I have to correct a possible misimpression about my positon on the cap.
It was never my contention that O.J. must have worn the cap or that the hairs "consistent" with O.J.'s were his. My only consideration was that they were important to the killer because they could be linked to O.J. O.J. noted that the cap looked small which was an indication to me that the cap did belong to the kids - and the one the police didn't collect belonged to O.J.
The premise I was operating on was that the person who took the cap might have gotten the wrong one. But it didn't matter to the killer because 1) He couldn't tell the difference or 2) he knew enough about hair and fiber evidence to be satisfied that at least some of the hairs would be close enough to O.J.'s to count. If the cap disappeared the same time the keys did, he had a week to work it out.
If Nicole dyed the kids' hair that changes everything.
The kids did not have Caucasian hair. The hair inside the cap was Negroid. It was not treated (stronger link to O.J. except for the absence of dandruff that the police found on O.J.'s head). That means the cap on the murder scene couldn't have been the ones the kids played in. It could have been worn by O.J. (knit caps stretch) in the fall or winter when he didn't have dandruff problems (makes more sense, too), or it could have belonged to another black man with hair similar to O.J.'s… someone like Ron Shipp. Al Cowling's hair and Marcus Allen's hair were different.
The only treated hair on the cap was found on the outside and it was Caucasoid. It did not belong to Nicole, Ron or any of the police officers on the murder scene (did they count Roberts?).
Could it have belonged to Faye Resnick? I think so, but there is some confusion in the transcripts about the natural color and the dyed color of the Caucasian hair. In some places the dyed color was blonde. In other places it's not stated. I couldn't even tell for sure how many hairs the witness was talking about.
Can you tell from this testimony whether Special Agent Deedrick is talking about two hairs or three….?
MR. DEEDRICK: There were two hairs that were recovered from my Q15 which was from the outside of the hat which was a died head hair fragment exhibiting Caucasian characteristics and from Q19, which again from the outside of the cap, there was a light brown Caucasian head hair which was broken at the proximal end, it had treatment on the hair at the distal end, is about three inches long and it was not like--not like the victims.
There is also some questions in my mind about the Caucasian limb hairs found on the Rockingham glove that didn't come from the victims or the officers on the scene (that were counted - Again, did they count Roberts?). It wasn't the same as the treated hair on the cap…
MR. BAILEY: So on page 8, for instance, where we are looking at you examining hairs, at the top, for instance, dark brown, two dark brown Caucasian origin head hair fragments. Is that what "COHH" means?
MR. DEEDRICK: That's right.
