Unfortunately you never read Beaver's comments on the Simpson newsgroup that a defense attorney never, never, never, never ever assumes the burden of prioving anything in court, least of all presenting evidence of someone esle having committeed the crime. There are lots of people in jail because their lawyers failed to follow that advice and playd Perry masaon whose forte waas unamsking the real killer in court. Never happens. There are a number if high profile cases that invoved lawyers ignoring Beaver's instructions. There is the case of Kennedy releative where defense attorney put on lame alibi witnesses and also suggesting someone else did it. There was the case in NY of a husband whose wife went missing (body never found) and dfense attorney tried to point the finger at someone else along with, I believe, a witness who claimed to have seen the missing wife who was so demolished by prosecutors the court was left in stitches. These clients are in jail. The Kenn3edy kin could probably have gotten off had his attorneybeen satisfied merel;y to create massive doubt abut the prosecution's case, whih is all he had to do wo win.***********The defense it simply neither obligated nor has the resources to conduct the massive investigation needed to do successfully what you suggest. Moreover, once you even hint at starting down the road of offering an alternative sdcenario, unless you succeed and prove that case, your cliwent will lose because the jury will take that failure as evidence of guilt or the defense would not haVE TRIED TO PUT ON SUCH A LAME DEFENSE. Anyone who imagines the defense should have investigatged Furhamn to pin down his alibi or come up with stuff suggesting he was guulty rather than OJ has just watched far too many Perry Mason episodes. And those p[eople should stick with their day jobs rathert than suggest approaches defense lawyers should pursue for their clients. Just always remember Beaver's injunction about the obligation of the defense. It's the only winning strategy. Prien
