Prien: No bill was presented as evidence; the prosecution offered a posterboard entitled "Juditha Brown's Phone Record, June 12, 1994" as Exhibit 35; they didn't ask it to be marked as evidence. The exhibit had a cropped photocopy of the bill on it. Shapiro offered his stipulation and the judge explained to the jury that the stipulation could be considered as evidence. Not the Exhbit, the stipulation. Shapiro offered stipulation to something the prosecution didn't offer. The way I look at it, it's like if a street diagram is used at trial for people to put a mark on to indicate what they saw where: if the diagram is not to scale doesn't negate a person's testimony if they put an X on it.
