Dr. Johnson's appeal was based not only on the declaration by the Browns that they spoke to Nicole at 11 but on quotes from Lou in newspapers and the fact that Judy spoke openly about a 10 minutes call later on.

The problem is that Dr. Johnson went after the Brown's records when Nicole's should have been in the mix as well. Although the Browns just may have had a say so in that as well.

Just as Judy calling Nicole was a long distance call, any calls that Nicole made to Judy would be as well and it may well be that the call was initiated by Nicole and not Judy.

It may have been smart of the criminal defense team to hold back--it wasn't the civil trial. And it does no good towards helping OJ clear his name now if they won't reveal them.

And one thing we can't forget either is that Nicole had a cell phone as well. Perhaps she called them on her cell phone.

It can't be stressed enough how the judge in the civil trial controlled what the defense was allowed access to.
