Maybe before they knew she was going to use a time that did not fit the plan and at somepoint they were thinking about something with Kato, they made the forms. Now Kato did pled the 5th at first, but don't know what that would do with Jill.
Maybe this was a taunt by some one who knew they were lying about something.
Maybe Shively did it herself to get back into play. Who knows?
