New DNA Available

In a case here in Ky. was not publicized nationally, a man has been released from prison (70 year sentence) after serving over 5 years (about 7) for a rape and an attempted rape that he did not do.

He was convicted on eye-witness accounts (where he didn't match the original description). Also on "matches" of 6 hairs in a mask used by the rapist.

Barry Scheck and Innocence Project tested the 6 hairs with NEW DNA testing that makes it possible to test Shafts of hair rather than hair roots.

It was NOT the man's DNA. His conviction was overturned and was granted a new trial BUT the prosecutors have no intention of trying him again.

I just heard the DA's involved and they said that there was only a "similiar" match.

This test was Not available at the time of the rape (92) but IS available now. I assume from what was said that it was NOT available at the time of the OJS trial either.

I wanted to pass this along since although I have looked carefully, I have not seen this in the national press or the new test in the national media. charlie
