No way. I spent months on this. Everyone seems to think I just dashed off some bullshit in A Mountain of Evidence and Profile of a Killer to justify a pet theory. They invariably dash through it or "skim" it to "get the gist of if" and dash on to something else. I don't "dash off ANYTHING." I don't know how. The reason I haven't been posting lately is because I just don't have time to do it right.
Speed kills.
I'm not guessing about the timeline or the barking dogs (page 537-540 of Iago). Please don't tell me that you studied my barking dog timeline. I know how smart you are and based on that, I don't see how you could have - unless you found a factual or conceptual flaw I missed that renders it invalid. I don't think that's true, either. I worked just as hard to discredit it as I did to establish it. I couldn't. Neither has anyone else. I can write it but I can't make anyone slow down enough to attempt to follow it.
For the record, this is the short version…
Nine people testified about the time that they heard the dog begin to bark (there were actually two barking dogs, the second of whom started baring about five minutes after the first).
1) Only prosecution witness Pablo Fenjves testified that he heard the plaintiff wail of a dog starting at 10:15 or 10:20 judging by when the 10 o'clock news came on. He did not look at a clock. That's the witness you're referring to. He lived across the ally west of Nicole's condo. [An estimate based on an estimate - worthless]. 2) Eva Stein lived in the hose just north of Nicole's condo. She said she was awakened by the dog's barking between 10:15 and 10:45. She estimated that that dog started barking based on the 11 o'clock time that her boyfriend said he got home. [An estimate based on two estimates - worthless]. 3) Mark Sorfer lived in the house south of Nicole's on Bundy and Dorothy. He said that he heard the dog barking at 10:23. He said that he looked at the digital display on his VCR which was set five minutes ahead and the time was 10:28. This one gave me fits until I looked at a digital display and read "2" when the actual number was "3." I'm now convinced that he simply read the display incorrectly. You'll see why in a little bit. [A recollection based on a direct observation of the time. [Relevant.] 4) Ellen Aaronson estimated that she walked past the Bundy walkway at 10:28. She saw no blood. Smelled no blood. She heard no dog barking. She knew what time she left Mezzaluna because she and her date looked at the time and timed how long it took to get to the condo. [Direct observation of the time, credit card company record confirmation, empirical test of walking time to condo - Relevant] 5) Danny Mandel was walking with Aaronson. He estimated that they passed the walkway at 10:30. He saw no blood. He smelled no blood. He heard no dog barking. [Direct observation of the time, credit card company record confirmation, empirical test of walking time to condo - Relevant] 6) Francesca Harmon Drove past Nicole's condo at 10:25 according to the news on the radio. Window was cracked. She heard no dog barking. [Estimate based on recent radio report - Relevant. 7) Judy Telender was visiting her friend Denise Pilnak who lived on Bundy across from Dorothy. She did some work on Pilnak's computer and the time log said she finished at 10:18 (I'm not sure of that time; you'll have to look it up). They sat on Pilnak's porch and they both commented on how quiet it was. She left at 10:21. She knows because she looked at her watch. She heard no dog barking. [Estimate based on direct observation - Relevant] 8) Denise Pilnak, an obsessive timekeeper, went into her house after her friend left and talked to her mother until 10:28. She testified that she heard no barking at that time. She estimated that she heard the dog begin to bark at about 10:35. [Estimate corresponds with empirical data; phone record, computer log - Relevant). 9) Robert Heidstra said that he heard the Akita begin to bark at 10:35. Heidstra had a regular schedule. His estimate agrees with Pilnak's, which corroborates, Telender's, Harmon's, Mandel's and Aaronson's. If Storfer misread his digital readout, his testimony also fits. It fits too well for Storfer not to have read "2" when the display really said "3."
The dog could only have started barking between 10:33 and 10:35. --Jasper
