This is a summary of the rulings. I think the original might be fascinating reading.
The summary states:
"The court also found that the assistant district attorney who tried the case engaged in an extensive PATTERN of INAPPROPRIATE, and in some cases ILLEGAL CONDUCT in the course of the trial."
"We also conclude that the conduct of the prosecuting attorney in this cases DEMONSTRATED her DISREGARD for DUE PROCESS and FAIRNESS and was INEXCUSABLE'
(Caps mine)
THis was not used to overturn the case but could have been. They had Enough on the judge and court trial itself.
It seems the judge allowed that the ONLY proof of an arson fire was a "sniffing dog" allegedly sniffed out an accelerant> Like a hunting dog, "pointed" it. No tests were made to determine the presence of an accelerant or any evidence to the fact that the fire (in which a woman died) was anything but an accident.
But the most interesting part is what the judges say about Grace. (I'll bet in the original her name is used.) It states Plainly ILLEGAL and Inappropriate conduct.
THis whole case was based on the wife dying in a house fire and the husband is only burned and breaks a vertebrate in his back and lives. A couple who had a bad marriage and she was thinking of getting a divorce. No proof that the fire was arson.
BTW, there are accelerants all over almost anybody's house if you go and look for them. As i mentioned in another post, the lamp oil from one of those hurricane lanterns is "flammable". If your house burned, where that lantern was will show a "hotter" spot than elsewhere. That does not mean it was set with that lantern.
I sure wish we could get the original. Perhaps, it too is posted somewhere.
