Jean, They do apply in their home country but it seem that they can get in with a visa Pending and the visa is OK'd by State Dept.
Mohamad Atta returned to the USA and was allowed back in on a visa application. The visa didn't come thru OUR INS until about August of 2001 --AFTER he had already completed the flight training. The very reason he was asking for the new visa in the first place.
You may recall that just recently the flight school got Official notification of the visa ok just a couple of weeks ago--nearly 6 months after the 9-ll attack.
That was OUR doing--not the country of origin.
I fail to see how the person is allowed to come here and do the training and/or go to school BEFORE they receive the Visa. But this is what happened in Atta's case.
It seems to me that you can't do business where the proposed schooling and training is OVER with BEFORE the visa comes thru.
They wouldn't let you go do your trip and get your passport later.
It seems to me that until they can get a handle on this there should be a halt to these visas.
They need to stop and regroup. Find out where the ones who are "loose' in our country without visas aor on expired visas first and deal with those.
Concentrate on the long time applicants for green cards and citizenship and not take anymore til they get a handle on what they already have.
The INS has too much on its plate. You can't be tracking these missing folks done, tracking down illegals and handling new visas and NOW that the new law passed nearly a Million new applications are going to hit them in the so-called amensity. They can't handle the ones that they have. And a background check needs to be done on all these new people.
The last time that had something like this back in 1996, they fudged on the background checks and learned that they allowed 10,000 non-eligle people to become citizens so they could vote in the 96 election.
