Riske claimed to be able to see from the other side of the fence that Ron's eyes were open. I have seen photos and although his eyes are not completely closed, they are far from open.
He also may have been able to see this from his vantage point beside Nicole but not from the far side of the fence.
As Prien mentions, Ron's head was down and away from that vantage point at the fence.
One thing I have always found strange about the crime scene photos. While the photos of Nicole was shown over and over again, it was not til I saw the it on the Internet did I ever see one of Ron.
In fact, by the time I did, I was actually very much surprised at his body's location and the angle that it was. By Riske's description, such as leaning against a stump and up against the fence, and being able to reach through the fence to his eye, I assumed he was sitting up more than he was. It was a case of the description not matching the facts at all.
Now we know that Ron's leg was moved sometime during the night due to the photos of the glove where the glove is different and the location of his leg is different.
It sounds very much like he was moved during the night. Perhaps he fell over but rigor had set in with him at the angle he was leaning over.
Perhaps the body falling over would have moved the leg?? But what caused him to fall over?
In one photo his foot is practically touching the glove and in another it is further away. That was commented on in the trial.
There is a slight change in Nicole's position as well from one photo to the next. (the early one and the later one) Hers is not so noticable but was commented on in court.
I would say this was done in both cases by the EMT if there had been a photo taken before he arrived and one after but as we know it--that isn't the case. At least it is not what was testified to.
Riske's description was as if he could reach right in to a sitting up body and touch the eye. It was only later when the photos were finally seen, that we realized that it couldn't have happened as Riske described it. If he in fact did touch the eye at all.
There is also a question of which arm he would have to use too, Prien.
Using his right arm is out of the question if he is to Ron's back. And his right arm would have to be used if he got above Ron's head at the fence. It has been a while since I saw the pix, so I don't know how far up he could have gotten above Ron's head without being in a tree. Perhaps it is possible.
But, you know what? He never stated to my knowledge that it was anything but easy to reach in a touch his eye. charlie
